1.1A bill for an act
1.2relating to data practices; providing for optional disclosure of public appraisals
1.3by a government entity;amending Minnesota Statutes 2010, section 13.44,
1.4subdivision 3.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2010, section 13.44, subdivision 3, is amended to read:
1.7    Subd. 3. Real property; appraisal data. (a) Confidential or protected nonpublic
1.8data. Estimated or appraised values of individual parcels of real property that are made by
1.9personnel of a government entity or by independent appraisers acting for a government
1.10entity for the purpose of selling or acquiring land through purchase or condemnation are
1.11classified as confidential data on individuals or protected nonpublic data.
1.12    (b) Private or nonpublic data. Appraised values of individual parcels of real
1.13property that are made by appraisers working for fee owners or contract purchasers who
1.14have received an offer to purchase their property from a government entity are classified
1.15as private data on individuals or nonpublic data.
1.16    (c) Public data. The data made confidential or protected nonpublic under paragraph
1.17(a) or made private or nonpublic under paragraph (b) become public upon the occurrence
1.18of any of the following:
1.19    (1) the data are submitted to a court-appointed condemnation commissioner;
1.20    (2) the data are presented in court in condemnation proceedings; or
1.21    (3) the negotiating parties enter into an agreement for the purchase and sale of the
1.22property.
2.1The data made confidential or protected nonpublic under paragraph (a) also become
2.2public at the discretion of the government entity, determined by majority vote of the
2.3governing body.

2.4    Sec. 2. EFFECTIVE DATE.
2.5Section 1 is effective the day following final enactment.
