1.1A bill for an act
1.2relating to elections; changing certain voter registration requirements and
1.3provisions;amending Minnesota Statutes 2010, sections 13.607, by adding a
1.4subdivision; 201.121, subdivision 2; 201.161; 204C.08, by adding a subdivision.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2010, section 13.607, is amended by adding a
1.7subdivision to read:
1.8    Subd. 9. Data derived from driver's license applications. Data on an application
1.9for a driver's license, a Minnesota identification card, or a learner's permit transferred to
1.10the secretary of state that are provided by a person whom the secretary of state determines
1.11is not eligible to vote is governed by section 201.161.

1.12    Sec. 2. Minnesota Statutes 2010, section 201.121, subdivision 2, is amended to read:
1.13    Subd. 2. Notice of registration; challenges. The county auditor shall mail a notice
1.14indicating the individual's name, address, precinct and polling place to each registered
1.15voter. The notice must inform the voter that if eligible, the voter is now registered to
1.16vote, that it is a felony to vote if an individual is not eligible, and that the voter should
1.17immediately call the county auditor if the voter is not eligible or does not want to be
1.18registered to vote. The notice must contain a description of voter eligibility criteria. The
1.19notice must also inform the voter that the voter may contact the county auditor to correct
1.20the registration. The notice must provide the contact information for the county auditor.
1.21The notice shall indicate that it must be returned if it is not deliverable to the voter at the
1.22named address. Upon return of the notice by the postal service, the county auditor shall
1.23change the registrant's status to "challenged" in the statewide registration system. An
2.1individual challenged in accordance with this subdivision shall comply with the provisions
2.2of section 204C.12, before being allowed to vote.

2.3    Sec. 3. Minnesota Statutes 2010, section 201.161, is amended to read:
2.4201.161 AUTOMATIC REGISTRATION OF DRIVER'S LICENSE,
2.5INSTRUCTION PERMIT, AND IDENTIFICATION CARD APPLICATIONS
2.6APPLICANTS.
2.7    Subdivision 1. Automatic registration. An individual who properly completes
2.8an application for a new or renewed Minnesota driver's license, instruction permit, or
2.9identification card, and who is eligible to vote under section 201.014, must be registered to
2.10vote as provided in this section, unless the applicant declines to be registered.
2.11    Subd. 2. Applications. The Department commissioner of public safety, in
2.12consultation with the secretary of state, shall change its the applications for an original,
2.13duplicate, or change of address driver's license, instruction permit, or identification card so
2.14that the forms may also serve as voter registration applications. The forms must contain
2.15spaces for all information collected by voter registration applications prescribed by the
2.16secretary of state and a box for the applicant to decline to be registered to vote. Applicants
2.17for driver's licenses or identification cards must be asked if they want to register to vote
2.18at the same time and that information must be transmitted at least weekly Unless the
2.19applicant has declined to be registered to vote or has provided an address other than the
2.20applicant's address of residence under section 5B.05 or 171.12, subdivision 7, paragraph
2.21(d), the commissioner shall transmit the information daily by electronic means to the
2.22secretary of state. Pursuant to the Help America Vote Act of 2002, Public Law 107-252,
2.23the computerized driver's license record containing the voter's name, address, date of
2.24birth, citizenship, driver's license number or state identification number, county, town, and
2.25city or town, and signature must be made available for access by the secretary of state and
2.26interaction with the statewide voter registration system.
2.27    Subd. 3. Registration. (a) The secretary of state shall determine whether the
2.28applicant is currently registered in the statewide voter registration system. For each
2.29currently registered voter whose name or address data is identical, the secretary of state
2.30shall update the voter's registration data in the statewide voter registration system. For
2.31each currently registered voter whose name or address data is not identical, the secretary
2.32of state shall transmit the registration daily by electronic means to the county auditor of
2.33the county where the voter resides.
2.34(b) If the applicant is not currently registered in the statewide voter registration
2.35system, the secretary of state shall determine whether the data indicate that the applicant
3.1is 18 years of age or older and a citizen of the United States and compare the voter
3.2registration information received from the commissioner of public safety with the
3.3information on wards, incompetents, and felons received from the state court administrator
3.4under sections 201.15 and 201.155, and with data received from the commissioner of
3.5corrections under section 201.157, to determine whether the applicant is ineligible to
3.6vote. If an applicant is less than 18 years of age, the secretary of state shall wait until the
3.7applicant has turned 18 years of age to determine whether the applicant is otherwise
3.8ineligible to vote. For each applicant the secretary of state has not found to be ineligible,
3.9the secretary of state shall transmit the registration daily by electronic means to the county
3.10auditor of the county where the voter resides.
3.11(c) Any data on applicants who the secretary of state determines are not eligible to
3.12vote are private data on individuals.
3.13    Subd. 4. Notice. Upon receipt of the registration, the county auditor shall process
3.14the registration and mail to the voter the notice of registration required by section 201.121,
3.15subdivision 2.
3.16    Subd. 5. Effective date. An application for registration that is dated during the 20
3.17days before an election in any jurisdiction within which the voter resides is not effective
3.18until the day after the election.

3.19    Sec. 4. Minnesota Statutes 2010, section 204C.08, is amended by adding a subdivision
3.20to read:
3.21    Subd. 2b. Roster notice. A notice must be placed prominently by the roster to
3.22inform each voter that by signing the roster, the voter is swearing or affirming that the
3.23voter is eligible to vote, and that it is a felony for an individual to vote if the individual is
3.24not eligible. The notice must provide a description of eligibility criteria for voting.

3.25    Sec. 5. EFFECTIVE DATE.
3.26Sections 1 to 4 are effective on August 1, 2015.
