1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.7 Section 1. Minnesota Statutes 2010, section 122A.414, subdivision 1a, is amended to
1.8read:
1.9 Subd. 1a. Transitional planning year. (a) To be eligible to participate in an
1.10alternative teacher professional pay system, a school district, intermediate school district,
1.11or site, at least one school year before it expects to fully implement an alternative pay
1.12system, must:
1.13(1) submit to the department a letter of intent executed by the school district or
1.14intermediate school district and the exclusive representative of the teachers to complete a
1.15plan preparing for full implementation, consistent with subdivision 2, that may include,
1.16among other activities, training to evaluate teacher performance, a restructured school
1.17day to develop integrated ongoing site-based professional development activities, release
1.18time to develop an alternative pay system agreement, and teacher and staff training on
1.19using multiple data sources; and
1.20(2) agree to use up to two percent of basic revenue for staff development purposes,
1.21consistent withsections section
122A.60 and
122A.61 , to develop the alternative teacher
1.22professional pay system agreement under this section.
1.23(b) To be eligible to participate in an alternative teacher professional pay system, a
1.24charter school, at least one school year before it expects to fully implement an alternative
1.25pay system, must:
2.1(1) submit to the department a letter of intent executed by the charter school and the
2.2charter school board of directors;
2.3(2) submit the record of a formal vote by the teachers employed at the charter
2.4school indicating at least 70 percent of all teachers agree to implement the alternative
2.5pay system; and
2.6(3) agree to use up to two percent of basic revenue for staff development purposes,
2.7consistent withsections section
122A.60 and
122A.61 , to develop the alternative teacher
2.8professional pay system.
2.9(c) The commissioner may waive the planning year if the commissioner determines,
2.10based on the criteria under subdivision 2, that the school district, intermediate school
2.11district, site or charter school is ready to fully implement an alternative pay system.
2.12EFFECTIVE DATE.This section is effective July 1, 2011.
2.13 Sec. 2. Minnesota Statutes 2010, section 122A.414, subdivision 4, is amended to read:
2.14 Subd. 4. Planning and staff development. A school district that qualifies to
2.15participate in the alternative teacher professional pay system transitional planning year
2.16under subdivision 1a may use up to two percent of its general education basic revenue
2.17that would otherwise be reserved under section
122A.61 for complying with the planning
2.18and staff development activities under this section.
2.19EFFECTIVE DATE.This section is effective July 1, 2011.
2.20 Sec. 3. Minnesota Statutes 2010, section 122A.60, subdivision 1, is amended to read:
2.21 Subdivision 1. Staff development committee. A school boardmust use the revenue
2.22authorized in section
122A.61 for in-service education for programs under section
2.23120B.22, subdivision 2, or for staff development plans may implement a staff development
2.24plan under this section. If a school board implements a plan under this section, the board
2.25must establish an advisory staff development committee to develop the plan, assist site
2.26professional development teams in developing a site plan consistent with the goals of the
2.27plan, and evaluate staff development efforts at the site level. A majority of the advisory
2.28committee and the site professional development team must be teachers representing
2.29various grade levels, subject areas, and special education. The advisory committee must
2.30also include nonteaching staff, parents, and administrators.
2.31EFFECTIVE DATE.This section is effective July 1, 2011.
2.32 Sec. 4. Minnesota Statutes 2010, section 122A.60, subdivision 1a, is amended to read:
3.1 Subd. 1a. Effective staff development activities.(a) Staff development activities
3.2implemented under this section must:
3.3(1) focus on the school classroom and research-based strategies that improve student
3.4learning;
3.5(2) provide opportunities for teachers to practice and improve their instructional
3.6skills over time;
3.7(3) provide opportunities for teachers to use student data as part of their daily work
3.8to increase student achievement;
3.9(4) enhance teacher content knowledge and instructional skills;
3.10(5) align with state and local academic standards;
3.11(6) provide opportunities to build professional relationships, foster collaboration
3.12among principals and staff who provide instruction, and provide opportunities for
3.13teacher-to-teacher mentoring; and
3.14(7) align with the plan of the district or site for an alternative teacher professional
3.15pay system.
3.16Staff development activities may include curriculum development and curriculum training
3.17programs, and activities that provide teachers and other members of site-based teams
3.18training to enhance team performance. The school district also may implement other
3.19staff development activities required by law and activities associated with professional
3.20teacher compensation models.
3.21(b) Release time provided for teachers to supervise students on field trips and school
3.22activities, or independent tasks not associated with enhancing the teacher's knowledge
3.23and instructional skills, such as preparing report cards, calculating grades, or organizing
3.24classroom materials, may not be counted as staff development time that is financed with
3.25staff development reserved revenue under section
122A.61.
3.26EFFECTIVE DATE.This section is effective July 1, 2011.
3.27 Sec. 5. Minnesota Statutes 2010, section 122A.60, subdivision 4, is amended to read:
3.28 Subd. 4. Staff development report. (a) By October 15 of each year,the a district
3.29and implementing a staff development plan under this section, in conjunction with its
3.30site staff development committees, shall write and submit a report of staff development
3.31activities and expenditures for the previous year, in the form and manner determined by
3.32the commissioner. The report, signed by the district superintendent and staff development
3.33chair, must include assessment and evaluation data indicating progress toward district and
3.34site staff development goals based on teaching and learning outcomes, including the
4.1percentage of teachers and other staff involved in instruction who participate in effective
4.2staff development activities under subdivision 3.
4.3(b) The report must break down expenditures for:
4.4(1) curriculum development and curriculum training programs; and
4.5(2) staff development training models, workshops, and conferences, and the cost of
4.6releasing teachers or providing substitute teachers for staff development purposes.
4.7The report also must indicate whether the expenditures were incurred at the district
4.8level or the school site level, and whether the school site expenditures were made possible
4.9by grants to school sites that demonstrate exemplary use of allocated staff development
4.10revenue. These expenditures must be reported using the uniform financial and accounting
4.11and reporting standards.
4.12(c) The commissioner shall report the staff development progress and expenditure
4.13data to the house of representatives and senate committees having jurisdiction over
4.14education by February 15 each year.
4.15EFFECTIVE DATE.This section is effective July 1, 2011.
4.16 Sec. 6. REPEALER.
4.17Minnesota Statutes 2010, section 122A.61, is repealed.
