1.1A bill for an act
1.2relating to education; allowing freshmen and sophomores to enroll in college
1.3in the schools classes;amending Minnesota Statutes 2010, section 124D.09,
1.4subdivisions 4, 5, 7, 8.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2010, section 124D.09, subdivision 4, is amended to
1.7read:
1.8    Subd. 4. Alternative pupil. "Alternative pupil" means an 9th, 10th, 11th, or 12th
1.9grade student not enrolled in a public school district, and includes students attending
1.10nonpublic schools and students who are home schooled. An alternative pupil is considered
1.11a pupil for purposes of this section only. An alternative pupil must register with the
1.12commissioner of education before participating in the postsecondary enrollment options
1.13program. The commissioner shall prescribe the form and manner of the registration, in
1.14consultation with the Nonpublic Education Council under section 123B.445, and may
1.15request any necessary information from the alternative pupil.

1.16    Sec. 2. Minnesota Statutes 2010, section 124D.09, subdivision 5, is amended to read:
1.17    Subd. 5. Authorization; notification. Notwithstanding any other law to the
1.18contrary, an 11th or 12th grade pupil enrolled in a school or an American Indian-controlled
1.19tribal contract or grant school eligible for aid under section 124D.83, except a foreign
1.20exchange pupil enrolled in a district under a cultural exchange program, may apply to an
1.21eligible institution, as defined in subdivision 3, to enroll in nonsectarian courses offered by
1.22that postsecondary institution. Notwithstanding any other law to the contrary, a 9th or 10th
1.23grade pupil enrolled in a school or an American Indian-controlled tribal contract or grant
2.1school eligible for aid under section 124D.83, except a foreign exchange pupil enrolled in
2.2a district under a cultural exchange program, may apply to enroll in nonsectarian courses
2.3offered under subdivision 10, if after all 11th and 12th grade students have applied for a
2.4course, additional students are necessary to offer the course. If an institution accepts a
2.5secondary pupil for enrollment under this section, the institution shall send written notice
2.6to the pupil, the pupil's school or school district, and the commissioner within ten days of
2.7acceptance. The notice must indicate the course and hours of enrollment of that pupil. If
2.8the pupil enrolls in a course for postsecondary credit, the institution must notify the pupil
2.9about payment in the customary manner used by the institution.

2.10    Sec. 3. Minnesota Statutes 2010, section 124D.09, subdivision 7, is amended to read:
2.11    Subd. 7. Dissemination of information; notification of intent to enroll. By March
2.121 of each year, a district must provide general information about the program to all pupils
2.13in grades 8, 9, 10, and 11. To assist the district in planning, a pupil shall inform the district
2.14by March 30 of each year of the pupil's intent to enroll in postsecondary courses during
2.15the following school year. A pupil is not bound by notifying or not notifying the district
2.16by March 30.

2.17    Sec. 4. Minnesota Statutes 2010, section 124D.09, subdivision 8, is amended to read:
2.18    Subd. 8. Limit on participation. A pupil who first enrolls in grade 9 may not
2.19enroll in postsecondary courses under this section for secondary credit for more than
2.20the equivalent of four academic years. A pupil who first enrolls in grade 10 may not
2.21enroll in postsecondary courses under this section for secondary credit for more than
2.22the equivalent of three academic years. A pupil who first enrolls in grade 11 may not
2.23enroll in postsecondary courses under this section for secondary credit for more than the
2.24equivalent of two academic years. A pupil who first enrolls in grade 12 may not enroll in
2.25postsecondary courses under this section for secondary credit for more than the equivalent
2.26of one academic year. If a pupil in grade 9, 10, 11, or 12 first enrolls in a postsecondary
2.27course for secondary credit during the school year, the time of participation shall be
2.28reduced proportionately. If a pupil is in a learning year or other year-round program and
2.29begins each grade in the summer session, summer sessions shall not be counted against the
2.30time of participation. A pupil who has graduated from high school cannot participate in a
2.31program under this section. A pupil who has completed course requirements for graduation
2.32but who has not received a diploma may participate in the program under this section.
