1.1A bill for an act
1.2relating to retirement; Teachers Retirement Association; providing for an
1.3Anoka-Hennepin school district teacher to receive service credit for a voluntary
1.4layoff and extended leave of absence.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. TEACHERS RETIREMENT ASSOCIATION; SERVICE
1.7CREDIT FOR VOLUNTARY LAYOFF AND EXTENDED LEAVE PERIODS;
1.8ANOKA-HENNEPIN TEACHER.
1.9(a) An eligible person described in paragraph (b) must be granted allowable and
1.10formula service credit in the Teachers Retirement Association for the period of voluntary
1.11layoff or "other" leave, and for an extended leave of absence specified in paragraph (b),
1.12notwithstanding Minnesota Statutes, section 354.05, subdivision 13, and section 354.094.
1.13(b) An eligible person is a person who:
1.14(1) was born on August 13, 1951;
1.15(2) became a member of the Teachers Retirement Association in 1977 due to
1.16teaching service in Lynd, Minnesota;
1.17(3) began Independent School District No. 11, Anoka-Hennepin, teaching service in
1.18January 1979;
1.19(4) went on a voluntary layoff or miscellaneous "other" leave of absence from
1.20July 1, 1989, to June 30, 1991, followed by an extended leave of absence from July 1,
1.211991, to June 30, 1994;
1.22(5) was not informed by Independent School District No. 11, Anoka-Hennepin, of
1.23his right to continue to make the contributions required to receive service credit for the
1.24extended leave and therefore did not make such contributions; and
2.1(6) returned to teaching service approximately six years after the end of the extended
2.2leave.
2.3(c) Independent School District No. 11, Anoka-Hennepin, must pay the Teachers
2.4Retirement Association the full actuarial value as determined under Minnesota Statutes,
2.5section 356.551, of the service credit granted by this section. Payment must be made
2.6within 30 days of the effective date of this section.
2.7EFFECTIVE DATE.This section is effective the day following final enactment.
