1.1A bill for an act
1.2relating to liquor; allowing farm wineries to sell growlers;amending Minnesota
1.3Statutes 2012, section 340A.315, by adding a subdivision.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. Minnesota Statutes 2012, section 340A.315, is amended by adding a
1.6subdivision to read:
1.7    Subd. 10. Growler sales. A farm winery may sell farm wines produced at the
1.8farm winery in 64-ounce containers commonly known as "growlers." The containers or
1.9bottles shall bear a twist-type closure, cork, stopper, or plug. At the time of the sale, a
1.10paper or plastic adhesive band, strip, or sleeve shall be applied to the container or bottle
1.11and extended over the top of the twist-type closure, cork, stopper, or plug forming a seal
1.12that must be broken upon opening of the container or bottle. The adhesive band, strip, or
1.13sleeve shall bear the name and address of the farm winery. The containers or bottles shall
1.14be identified as wine, contain the name of the wine, bear the name and address of the farm
1.15winery selling the wine, and shall be considered intoxicating liquor unless the alcoholic
1.16content is labeled as otherwise in accordance with Minnesota Rules, part 7515.1100.
1.17EFFECTIVE DATE.This section is effective the day following final enactment.
