1.1A bill for an act
1.2relating to child care; modifying a child care licensure requirement;amending
1.3Minnesota Statutes 2010, section 245A.1435.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. Minnesota Statutes 2010, section 245A.1435, is amended to read:
1.6245A.1435 REDUCTION OF RISK OF SUDDEN INFANT DEATH
1.7SYNDROME IN LICENSED PROGRAMS.
1.8    (a) When a license holder is placing an infant to sleep, the license holder must
1.9place the infant on the infant's back, unless the license holder has documentation from
1.10the infant's parent doctor directing an alternative sleeping position for the infant. The
1.11parent doctor directive must be on a form approved by the commissioner and must include
1.12a statement that the parent or legal guardian has read the information provided by the
1.13Minnesota Sudden Infant Death Center, related to the risk of SIDS and the importance of
1.14placing an infant or child on its back to sleep to reduce the risk of SIDS.
1.15(b) The license holder must place the infant in a crib directly on a firm mattress with
1.16a fitted crib sheet that fits tightly on the mattress and overlaps the mattress so it cannot
1.17be dislodged by pulling on the corner of the sheet. The license holder must not place
1.18pillows, quilts, comforters, sheepskin, pillow-like stuffed toys, or other soft products in
1.19the crib with the infant. The requirements of this section apply to license holders serving
1.20infants up to and including 12 months of age. Licensed child care providers must meet the
1.21crib requirements under section 245A.146.
