1.1A bill for an act
1.2relating to data practices; government data; genetic test;amending Minnesota
1.3Statutes 2010, section 13.386, subdivision 1.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. Minnesota Statutes 2010, section 13.386, subdivision 1, is amended to read:
1.6    Subdivision 1. Definition Definitions. (a) "Genetic information" means information
1.7about an identifiable individual derived from the presence, absence, alteration, or mutation
1.8of a gene, or the presence or absence of a specific DNA or RNA marker, which has been
1.9obtained from an analysis a genetic test of:
1.10(1) the individual's biological information or specimen; or
1.11(2) the biological information or specimen of a person to whom the individual
1.12is related.
1.13(b) "Genetic information" also means medical or biological information collected
1.14from an individual about a particular genetic condition that is or might be used to provide
1.15medical care to that individual or the individual's family members.
1.16(c) "Genetic test" means an analysis of human DNA, RNA, and chromosomes. It
1.17does not include an analysis of proteins or metabolites that does not detect genotypes,
1.18mutations, or chromosomal changes.
