1.1A bill for an act
1.2relating to land; requiring transfer of federal lands to the state;proposing coding
1.3for new law in Minnesota Statutes, chapter 94.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. [94.56] TRANSFER OF FEDERAL LANDS.
1.6    Subdivision 1. Definition. For the purposes of this section, "federal lands" includes
1.7lands the United States holds title to within the state and does not include:
1.8(1) land belonging to an American Indian tribe held in trust by the United States; and
1.9(2) land designated as a national park, national monument, national wilderness, or
1.10national historic site on or before January 1, 2012.
1.11    Subd. 2. Transfer of lands. On or before December 31, 2014, the United States
1.12shall:
1.13(1) extinguish title to federal lands within the state; and
1.14(2) transfer title of the federal lands to the state.
1.15    Subd. 3. Disposition of proceeds from transferred lands. If the state transfers
1.16title to lands transferred to the state under subdivision 2, the state shall retain five percent
1.17of the proceeds from the transfer. The remainder of the proceeds shall be transferred to
1.18the United States.
1.19    Subd. 4. Commissioner's duties. (a) By January 15, 2013, the commissioner
1.20of natural resources shall:
1.21(1) coordinate the transfer of title of federal lands to the state;
1.22(2) create a plan for the management of the federal lands transferred to the state
1.23under this section; and
2.1(3) prepare draft legislation necessary to facilitate the transfer and management
2.2of federal lands under this section and submit the draft legislation to the chairs of the
2.3house of representatives and senate committees with jurisdiction over the environment
2.4and natural resources.
2.5(b) If the United States fails to transfer lands as required under subdivision 2, the
2.6commissioner shall establish actions that shall be taken to secure, preserve, and protect
2.7the state's rights and benefits provided under this section.
2.8    Subd. 5. Severability. If any provision of this section is held invalid, illegal, or
2.9unenforceable for any reason and in any respect, the holding does not affect the validity
2.10of the remainder of the section.
2.11EFFECTIVE DATE.This section is effective the day following final enactment.
