1.2relating to state government; proposing an amendment to the Minnesota
1.3Constitution, article V, sections 1, 2, 5; abolishing the office of lieutenant
1.4governor.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. CONSTITUTIONAL AMENDMENTS PROPOSED.
1.7An amendment to the Minnesota Constitution is proposed to the people. If the
1.8amendment is adopted,
1.9article V, section 1, will read:
1.10Section 1. The executive department consists of a governor,lieutenant governor,
1.11secretary of state, auditor, and attorney general, who shall be chosen by the electors of
1.12the state.The governor and lieutenant governor shall be chosen jointly by a single vote
1.13applying to both offices in a manner prescribed by law.
1.14article V, section 2, will read:
1.15Sec. 2. The term of office for the governorand lieutenant governor is four years and
1.16until a successor is chosen and qualified.Each The governor shall have attained the age of
1.1725 years and, shall have been a bona fide resident of the state for one year next preceding
1.18his election, and shall be a citizen of the United States.
1.19article V, section 5, will read:
1.20Sec. 5. In case a vacancy occurs from any cause whatever in the office of governor,
1.21thelieutenant governor secretary of state shall be governor during such vacancy. The
1.22compensation of the lieutenant governor shall be prescribed by law. The last elected
1.23presiding officer of the senate shall becomelieutenant governor in case a vacancy
1.24occurs inthat office the offices of governor and secretary of state. In case the governor
2.1is unable to discharge the powers and duties of his or her office, the same devolves on
2.2thelieutenant governor secretary of state. The legislature may provide by law for the
2.3case of the removal, death, resignation, or inability both of the governor andlieutenant
2.4governor secretary of state to discharge the duties of governor and may provide by law
2.5for continuity of government in periods of emergency resulting from disasters caused by
2.6enemy attack in this state, including, but not limited to, succession to the powers and
2.7duties of public office and change of the seat of government.
2.8 Sec. 2. SCHEDULE AND QUESTION.
2.9The proposed amendment shall be submitted to the people at the 2012 general
2.10election and, if approved, shall take effect on the first Monday in January 2015. The
2.11question submitted shall be:
2.12"Shall the Minnesota Constitution be amended to abolish the office of lieutenant
2.13governor on the first Monday in January 2015?
