1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2010, section 169.87, subdivision 6, is amended to read:
1.7 Subd. 6.Recycling and garbage vehicles Vehicle transporting recycling
1.8material, solid waste, or sewage. (a) Except as provided in paragraph (b), weight
1.9restrictions imposed under subdivisions 1 and 2 do not apply to a vehicle that does not
1.10exceed 20,000 pounds per single axle and is designed and used exclusively for recycling,
1.11while engaged in recycling in a political subdivision that mandates curbside recycling
1.12pickup.
1.13(b) Weight restrictions imposed under subdivisions 1 and 2 do not apply to (1) a
1.14vehicle that does not exceed 14,000 pounds per single axle and is used exclusively for
1.15recycling as described in paragraph (a), or (2) a vehicle that does not exceed 14,000 pounds
1.16per single axle and is designed and used exclusively for collecting mixed municipal solid
1.17waste, as defined in section115A.03, subdivision 21 , or sewage, as defined in section
1.18115.01, subdivision 17, while engaged in such collection.
1.19(c) Notwithstanding section169.80, subdivision 1 , a violation of weight restrictions
1.20imposed under subdivisions 1 and 2 by a vehicle designed and used exclusively for
1.21recycling while engaged in recycling in a political subdivision that mandates curbside
1.22recycling pickup while engaged in such collection, or by a vehicle that is designed and
1.23used exclusively for collecting mixed municipal solid waste as defined in section115A.03,
1.24subdivision 21 , or sewage, as defined in section 115.01, subdivision 17, while engaged
2.1in such collection, is not subject to criminal penalties but is subject to a civil penalty
2.2for excess weight under section169.871 .
