1.1A bill for an act
1.2relating to transportation; mass transit; transit fares; establishing a distance-based
1.3fare surcharge pilot program for replacement service transit providers.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. DISTANCE-BASED FARE SURCHARGE; PILOT PROGRAM.
1.6    Subdivision 1. Pilot program authorized. Notwithstanding Minnesota Statutes,
1.7section 473.408, subdivision 2a, or any other law to the contrary, replacement service
1.8transit providers operating under Minnesota Statutes, section 473.388, may establish a
1.9pilot program that adds a distance-based surcharge to standard transit fares.
1.10    Subd. 2. Pilot program restrictions. (a) A replacement service transit provider
1.11exercising its authority under subdivision 1 may only impose a distance-based surcharge
1.12on routes with a total length greater than 15 miles.
1.13(b) Any distance-based surcharge imposed must be prorated on the basis of the
1.14distance traveled by the rider paying the surcharge.
1.15    Subd. 3. Reporting requirements. By August 1 of each year a pilot program is
1.16in effect, the replacement service transit provider imposing the distance-based surcharge
1.17shall submit to the chairs and ranking minority members of the house of representatives
1.18and senate committees having jurisdiction over transportation policy and finance a
1.19report detailing the activities of the pilot program. The report shall include information
1.20specifying the total revenue collected from the distance-based surcharge and the average
1.21surcharge collected per rider, analyzing any impact the surcharge has had on the fare
1.22policy considerations under Minnesota Statutes, section 473.408, subdivision 2, and any
1.23other information requested by the chairs of the house of representatives and senate
1.24committees having jurisdiction over transportation policy and finance.
2.1EFFECTIVE DATE.This section is effective the day following final enactment
2.2and expires on January 1, 2016.
