1.1A bill for an act
1.2relating to commerce; protecting the health of children; prohibiting formaldehyde
1.3in products for children;proposing coding for new law in Minnesota Statutes,
1.4chapter 325F.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. [325F.174] DEFINITIONS.
1.7(a) For the purposes of sections 325F.174 to 325F.176, the following terms have
1.8the meanings given them.
1.9(b) "Child" means a person under 12 years of age.
1.10(c) "Children's product" means a consumer product intended for use by a child, such
1.11as baby products, toys, car seats, crib sheets, personal care products, and clothing.
1.12EFFECTIVE DATE.This section is effective the day following final enactment.

1.13    Sec. 2. [325F.175] FORMALDEHYDE IN CHILDREN'S PRODUCTS.
1.14By January 1, 2013, no manufacturer may sell or offer for sale in this state a
1.15children's product that contains formaldehyde.
1.16EFFECTIVE DATE.This section is effective the day following final enactment.

1.17    Sec. 3. [325F.176] REPLACEMENT CHEMICALS.
1.18A manufacturer shall not replace formaldehyde as a result of the prohibitions in
1.19section 325F.175 with a chemical that has been identified as a priority chemical under
1.20section 116.9403.
1.21EFFECTIVE DATE.This section is effective the day following final enactment.
