1.1A bill for an act
1.2proposing an amendment to the Minnesota Constitution, article VII, section
1.31; allowing agricultural land, nonhomesteaded, noncommercial real property
1.4owners, and small business property owners to vote on bonding and property
1.5tax questions where the property is located; providing implementing language;
1.6proposing coding for new law in Minnesota Statutes, chapter 204B.
1.7BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.8    Section 1. CONSTITUTIONAL AMENDMENT PROPOSED.
1.9An amendment to the Minnesota Constitution is proposed to the people. If the
1.10amendment is adopted, article VII, section 1, will read:
1.11Section 1. Every person 18 years of age or more who has been a citizen of the United
1.12States for three months and who has resided in the precinct for 30 days next preceding an
1.13election shall be entitled to vote in that precinct. In addition, every person 18 years of age
1.14or more who has been a citizen of the United States and resident of this state for three
1.15months and who is the owner of agricultural land or nonhomesteaded, noncommercial
1.16real property or who is the owner of commercial or industrial real property and conducts
1.17on the property a small business as defined by law may vote in the precinct where the
1.18real property is located on any question concerning local levies or referendums. The
1.19place of voting by one otherwise qualified who has changed his residence within 30 days
1.20preceding the election shall be prescribed by law. The following persons shall not be
1.21entitled or permitted to vote at any election in this state: A person not meeting the above
1.22requirements; a person who has been convicted of treason or felony, unless restored to civil
1.23rights; a person under guardianship, or a person who is insane or not mentally competent.

1.24    Sec. 2. SUBMISSION TO VOTERS.
2.1The proposed amendment must be submitted to the people at the 2012 general
2.2election. The question submitted must be:
2.3"Shall the Minnesota Constitution be amended to allow the owner of agricultural
2.4land or nonhomesteaded, noncommercial real property or the owner of commercial or
2.5industrial real property who on that property conducts a small business as defined by law
2.6to vote on local levies or referendums where the real property is located?

2.9    Sec. 3. [204B.49] CERTAIN PROPERTY TAX AND BOND QUESTIONS;
2.10SECRETARY OF STATE RULES.
2.11The owner of agricultural land or nonhomesteaded, noncommercial real property or
2.12the owner of commercial or industrial real property who conducts on that property a small
2.13business as defined by law may vote in the precinct where the real property is located on
2.14any question concerning local levies or referendums. Owners may register to vote in
2.15the precinct, for purposes of these questions only, under procedures developed by the
2.16secretary of state by rule. Owners may vote by absentee ballot in the manner provided by
2.17chapter 203B or may vote in a mail election as provided in section 204B.45.

2.18    Sec. 4. EFFECTIVE DATE.
2.19Section 3 is effective upon ratification of the amendment proposed in section 1.
