1.1A bill for an act
1.2relating to state government; exempting a person who performs threading from
1.3licensing; authorizing the good cause exemption for rulemaking; amending
1.4Minnesota Statutes 2012, sections 155A.23, by adding a subdivision; 155A.27,
1.5subdivision 9; 155A.29, by adding a subdivision.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.7    Section 1. Minnesota Statutes 2012, section 155A.23, is amended by adding a
1.8subdivision to read:
1.9    Subd. 13. Threading. "Threading" is a method of removing hair from the eyebrows,
1.10upper lip, or other body parts by using cotton thread to pull hair from follicles. Threading
1.11does not include the use of chemicals or any type of wax. Threading may include the use
1.12of (1) over-the-counter astringents, gels, and powders; and (2) tweezers and scissors
1.13incidental to threading.

1.14    Sec. 2. Minnesota Statutes 2012, section 155A.27, subdivision 9, is amended to read:
1.15    Subd. 9. Exemptions. (a) Persons licensed to provide cosmetology services in
1.16other states visiting this state for cosmetology demonstrations shall be exempted from the
1.17licensing provisions of sections 155A.21 to 155A.36 if services to consumers are in the
1.18physical presence of a licensed cosmetologist.
1.19(b) A person who performs threading shall be exempt from the licensing provisions
1.20of sections 155A.21 to 155A.36.

1.21    Sec. 3. Minnesota Statutes 2012, section 155A.29, is amended by adding a subdivision
1.22to read:
2.1    Subd. 6. Exemption. The facility in which a person provides threading and no
2.2other services requiring licensure by this chapter is exempt from the requirement for a
2.3salon license under this section.

2.4    Sec. 4. RULEMAKING; THREADING.
2.5The Board of Cosmetologist Examiners shall amend Minnesota Rules, part
2.62105.0100, to exempt threading from the practice of cosmetology and classify it as an
2.7unregulated service. The board may use the good cause exemption under Minnesota
2.8Statutes, section 14.388, to adopt rules under this section, and Minnesota Statutes, section
2.914.386, does not apply except as provided under Minnesota Statutes, section 14.388.
