1.2relating to health; requiring a notice to be provided with certain mammogram
1.3results;proposing coding for new law in Minnesota Statutes, chapter 144.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5 Section 1. [144.1212] NOTICE TO PATIENT; MAMMOGRAM RESULTS.
1.6 Subdivision 1. Definition. For purposes of this section, "facility" has the meaning
1.7provided in United States Code, title 42, section 263b(a)(3)(A).
1.8 Subd. 2. Required notice. A facility at which a mammography examination is
1.9performed shall, if a patient is categorized by the facility as having heterogeneously
1.10dense breasts or extremely dense breasts based on the Breast Imaging Reporting and Data
1.11System established by the American College of Radiology, include in the summary of the
1.12written report that is sent to the patient, as required by the federal Mammography Quality
1.13Standards Act, United States Code, title 42, section 263b, the following notice:
1.14"Your mammogram shows that your breast tissue is dense. Dense breast tissue is
1.15relatively common and is found in more than 40 percent of women. However, dense
1.16breast tissue may make it more difficult to identify precancerous lesions or cancer through
1.17a mammogram and may also be associated with an increased risk of breast cancer. This
1.18information about the results of your mammogram is given to you to raise your own
1.19awareness and to help inform your conversations with your treating clinician who has
1.20received a report of your mammogram results. Together you can decide which screening
1.21options are right for you based on your mammogram results, individual risk factors,
1.22or physical examination."
