1.1A bill for an act
1.2relating to human services; classifying certain physician assistants as mental
1.3health professionals for purposes of medical assistance;amending Minnesota
1.4Statutes 2010, section 256B.0625, subdivision 42.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2010, section 256B.0625, subdivision 42, is amended to
1.7read:
1.8    Subd. 42. Mental health professional. (a) Notwithstanding Minnesota Rules,
1.9part 9505.0175, subpart 28, the definition of a mental health professional shall include a
1.10person who is qualified as specified in section 245.462, subdivision 18, clauses (5) and
1.11(6); or 245.4871, subdivision 27, clauses (5) and (6), for the purpose of this section and
1.12Minnesota Rules, parts 9505.0170 to 9505.0475.
1.13(b) Notwithstanding Minnesota Rules, part 9505.0175, subpart 28, the definition
1.14of a mental health professional shall include a physician assistant working under the
1.15supervision of a physician licensed under chapter 147 and certified by the American
1.16Board of Psychiatry and Neurology or eligible for board certification in psychiatry, for the
1.17purpose of this section and Minnesota Rules, parts 9505.0170 to 9505.0475.
