1.1A bill for an act
1.2relating to the city of Albert Lea; extending the expiration for local sales and
1.3use taxes; providing for local approval of certain laws and validating certain
1.4actions of the city;amending Laws 2005, First Special Session chapter 3, article
1.55, section 38, subdivision 4.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.7    Section 1. Laws 2005, First Special Session chapter 3, article 5, section 38, subdivision
1.84, is amended to read:
1.9    Subd. 4. Termination of taxes. The taxes imposed under this section expire at the
1.10earlier of (1) ten 15 years after the taxes are first imposed, or (2) when the city council first
1.11determines that the amount of revenues raised to pay for the projects under subdivision 2,
1.12shall meet or exceed the sum of $15,000,000. Any funds remaining after completion of
1.13the projects may be placed in the general fund of the city.
1.14EFFECTIVE DATE.This section is effective the day after compliance by the
1.15governing body of the city of Albert Lea with Minnesota Statutes, section 645.021,
1.16subdivisions 2 and 3.

1.17    Sec. 2. VALIDATION OF PRIOR ACT; AUTHORIZATION.
1.18Notwithstanding the time limits in Minnesota Statutes, section 645.021, the city of
1.19Albert Lea may approve Laws 2005, First Special Session chapter 3, article 5, section 38,
1.20as amended by Laws 2006, chapter 259, article 3, section 6, and file its approval with the
1.21secretary of state by June 15, 2014. If approved as authorized under this section, actions
1.22undertaken by the city pursuant to the approval of the voters on November 8, 2005, and
2.1otherwise in accordance with Laws 2005, First Special Session chapter 3, article 5, section
2.238, as amended by Laws 2006, chapter 259, article 3, section 6, are validated.
2.3EFFECTIVE DATE.This section is effective the day following final enactment.
