1.2relating to metropolitan government; authorizing new transit service opt-outs;
1.3amending Minnesota Statutes 2010, section 473.388, subdivision 2.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5 Section 1. Minnesota Statutes 2010, section 473.388, subdivision 2, is amended to read:
1.6 Subd. 2. Replacement service; eligibility. (a) The council may provide assistance
1.7under the program to a statutory or home rule charter city or town or combination thereof,
1.8that:
1.9(a) (1) is located in the metropolitan transit taxing district;
1.10(b) (2) is not served by the council bus service or is served only with council bus
1.11routes which begin or end within the applying city or town or combination thereof; and
1.12(c) (3) has fewer than four scheduled runs of council bus service during off-peak
1.13hours as defined by the Metropolitan Council.
1.14(b) Eligible cities or towns or combinations thereof may apply on behalf of a transit
1.15operator with whom they propose to contract for service.
1.16The council may not provide assistance under this section to a statutory or home rule
1.17charter city or town unless the city or town,
1.18(i) was receiving assistance under Minnesota Statutes 1982, section
174.265, by
1.19July 1, 1984,
1.20(ii) had submitted an application for assistance under that section by July 1, 1984, or
1.21(iii) had submitted a letter of intent to apply for assistance under that section by July
1.221, 1984, and submits an application for assistance under this section by July 1, 1988. A
1.23statutory or home rule charter city or town has an additional 12-month extension if it
1.24notified the former regional transit board before July 1, 1988, that the city or town is in the
2.1process of completing a transportation evaluation study that includes an assessment of
2.2the local transit needs of the city or town.
