1.3of certain motor vehicles;proposing coding for new law in Minnesota Statutes,
1.4chapter 343.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. [343.245] ANIMAL PROTECTION.
1.7 Subdivision 1. Required practice. A person who transports an animal on a public
1.8roadway in the cargo portion of a motor vehicle must ensure that the animal is protected in
1.9a manner that prevents the animal from falling, jumping, or being thrown from the vehicle.
1.10 Subd. 2. Compliance. A person complies with this section if:
1.11(1) the space is enclosed;
1.12(2) the space has racks on all open sides with adequate height and density to retain
1.13the animal;
1.14(3) the animal is cross-tethered to the vehicle; or
1.15(4) the animal is transported in a cage or container secured to the vehicle.
1.16 Subd. 3. Exception. Subdivision 1 does not apply to a dog being transported by:
1.17(1) a farmer, as defined in section 500.24, or a farm employee while the farmer or
1.18employee is engaged in agricultural activities on the farm or within five miles of the farm; or
1.19(2) a licensed hunter in possession of applicable licenses and permits who is engaged
1.20in hunting activities at or within five miles of a hunting site during the legal season for the
1.21hunting activities.
