1.2relating to human services; modifying the Minnesota family investment program;
1.3amending Minnesota Statutes 2013 Supplement, section 256J.35; Laws 2013,
1.4chapter 108, article 3, section 48.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2013 Supplement, section 256J.35, is amended to read:
1.7256J.35 AMOUNT OF ASSISTANCE PAYMENT.
1.8Except as provided in paragraphs (a) to (d), the amount of an assistance payment is
1.9equal to the difference between the MFIP standard of need or the Minnesota family wage
1.10level in section256J.24 and countable income.
1.11(a) Beginning July 1,2015 2014, MFIP assistance units are eligible for an MFIP
1.12housing assistance grant of $110 per month, unless:
1.13(1) the housing assistance unit is currently receiving public and assisted rental
1.14subsidies provided through the Department of Housing and Urban Development (HUD)
1.15and is subject to section256J.37, subdivision 3a ; or
1.16(2) the assistance unit is a child-only case under section256J.88 .
1.17(b) When MFIP eligibility exists for the month of application, the amount of the
1.18assistance payment for the month of application must be prorated from the date of
1.19application or the date all other eligibility factors are met for that applicant, whichever is
1.20later. This provision applies when an applicant loses at least one day of MFIP eligibility.
1.21(c) MFIP overpayments to an assistance unit must be recouped according to section
1.22256J.38, subdivision 4

1.23(d) An initial assistance payment must not be made to an applicant who is not
1.24eligible on the date payment is made.
2.1EFFECTIVE DATE.This section is effective July 1, 2014.
2.2 Sec. 2. Laws 2013, chapter 108, article 3, section 48, is amended to read:
2.3 Sec. 48. REPEALER.
2.4(a) Minnesota Statutes 2012, section 256J.24, subdivision 6, is repealed January
2.51,2015 2014.
2.6(b) Minnesota Statutes 2012, section 609.093, is repealed effective the day following
2.7final enactment.
2.8EFFECTIVE DATE.This section is effective retroactively from January 1, 2014.
2.9 Sec. 3. SPECIFIC USE OF TANF FUNDS.
2.10Beginning in fiscal year 2015, the entirety of the federal TANF block grant must
2.11be used for MFIP participants, and specifically to provide an MFIP assistance payment
2.12increase. All other activities currently funded using TANF funds, including but not limited
2.13to the working family credit, Department of Health programs, child care for non-MFIP
2.14families, social services block grants, and consolidated support services grants, must be
2.15paid with general fund dollars beginning in fiscal year 2015.
2.16EFFECTIVE DATE.This section is effective July 1, 2014.
