1.1A bill for an act
1.2relating to public health; expanding prohibition of bisphenol-A in products
1.3for young children;amending Minnesota Statutes 2010, sections 325F.172,
1.4subdivision 3; 325F.173.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2010, section 325F.172, subdivision 3, is amended to
1.7read:
1.8    Subd. 3. Children's product. "Children's product" means an empty bottle or cup
1.9to be filled with food or liquid that is designed or intended by a manufacturer to be used
1.10by a child, or a food container that is commercially available and contains food or liquid
1.11designed or intended by the manufacturer to be consumed by a child.

1.12    Sec. 2. Minnesota Statutes 2010, section 325F.173, is amended to read:
1.13325F.173 BISPHENOL-A IN CERTAIN CHILDREN'S PRODUCTS.
1.14(a) By January 1, 2010, no manufacturer or wholesaler may sell or offer for sale in
1.15this state a children's product that contains bisphenol-A.
1.16(b) This section does not apply to sale of a used children's product.
1.17(c) By January 1, 2011, no retailer may sell or offer for sale in this state a children's
1.18product that contains bisphenol-A.
1.19(d) Manufacturers must not replace bisphenol-A with carcinogens rated by the
1.20United States Environmental Protection Agency as A, B, or C carcinogens or substances
1.21listed on the Environmental Protection Agency's "List of Chemicals Evaluated for
1.22Carcinogenic Potential" as known or likely carcinogens, known to be human carcinogens,
1.23likely to be human carcinogens, or suggestive of being carcinogens.
2.1(e) Manufacturers must not replace bisphenol-A with reproductive toxicants that the
2.2United States Environmental Protection Agency has identified as causing birth defects,
2.3reproductive harm, or developmental harm.
