1.1A bill for an act
1.2relating to retirement; legislators in the unclassified program first elected after
1.3June 30, 1997; terminating contributions after June 30, 2012;proposing coding
1.4for new law in Minnesota Statutes, chapter 352D.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. [352D.045] LEGISLATOR COVERAGE RESTRICTIONS.
1.7    Subdivision 1. Termination of contributions. Notwithstanding section 352D.04,
1.8subdivision 2, for any legislator first elected after June 30, 1997, no employee or employer
1.9contributions can be made for legislative service provided after June 30, 2012, and the
1.10legislator is ineligible for coverage for legislative service provided after June 30, 2012, in
1.11any other Minnesota public pension plan.
1.12    Subd. 2. Use of Minnesota state deferred compensation plan. This section should
1.13not be interpreted as restricting any legislator's authority to participate in the Minnesota
1.14state deferred compensation plan under section 352.965.
1.15    Subd. 3. Limitation on withdrawals. An active legislator who has an unclassified
1.16program account due to legislative service and has further contributions terminated due
1.17to subdivision 1 is not considered to have terminated covered employment for purposes
1.18of section 352D.05.
1.19EFFECTIVE DATE.This section is effective July 1, 2012.
