1.1A bill for an act
1.2relating to human services; enacting Hanna's law by modifying cardiopulmonary
1.3resuscitation requirements for child care center staff;amending Minnesota
1.4Statutes 2010, section 245A.40, subdivision 4.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2010, section 245A.40, subdivision 4, is amended to
1.7read:
1.8    Subd. 4. Cardiopulmonary resuscitation. (a) All teachers and assistant teachers
1.9who are employed by a child care center governed by Minnesota Rules, parts 9503.0005
1.10to 9503.0170 must satisfactorily complete training in cardiopulmonary resuscitation
1.11(CPR) and in the treatment of obstructed airways including CPR techniques for infants
1.12and children. When children are present in a child care center governed by Minnesota
1.13Rules, parts 9503.0005 to 9503.0170, at least one staff person must be present in the
1.14center who has been trained in cardiopulmonary resuscitation (CPR) and in the treatment
1.15of obstructed airways. satisfactorily completed CPR training. During field trips and when
1.16transporting children in care, all teachers, assistant teachers, and at least one staff person
1.17must have completed CPR training. For the purposes of this subdivision, each teacher,
1.18assistant teacher, and staff person must complete CPR training within 90 days after the
1.19start of employment unless the individual has completed CPR training within the previous
1.20three years. The CPR training must have been provided by an individual approved to
1.21provide CPR instruction, must be repeated at least once every three years, and must be
1.22documented in the staff person's records.
1.23    (b) CPR training may be provided for less than four hours.
2.1    (c) Persons qualified to provide CPR training shall include individuals approved
2.2as CPR instructors.
