1.1A bill for an act
1.2relating to legislature; modifying membership of the Legislative Advisory
1.3Commission;amending Minnesota Statutes 2010, section 3.30, subdivision 2.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. Minnesota Statutes 2010, section 3.30, subdivision 2, is amended to read:
1.6    Subd. 2. Members; duties. The majority leader of the senate or a designee, the
1.7minority leader of the senate or a designee, the chair of the senate Committee on Finance,
1.8and the chair of the appropriate finance committee, or division of the senate Division of
1.9Finance responsible for overseeing the items being considered by the commission, the
1.10ranking minority member of the appropriate finance committee, or division of the senate
1.11responsible for overseeing the items being considered by the commission, the speaker of
1.12the house or a designee, the minority leader of the house of representatives or a designee,
1.13the chair of the house of representatives Committee on Ways and Means, and the chair of
1.14the appropriate finance committee, or division of the house of representatives committee
1.15responsible for overseeing the items being considered by the commissioner, commission,
1.16and the ranking minority member of the appropriate finance committee, or division of the
1.17house of representatives committee responsible for overseeing the items being considered
1.18by the commission constitute the Legislative Advisory Commission. The division chair
1.19and ranking minority member of the Finance Committee in the senate and the division
1.20chair and ranking minority member of the appropriate finance committee or division in
1.21the house of representatives shall rotate according to the items being considered by the
1.22commission. If any of the members elect not to serve on the commission, the house of
1.23which they are members, if in session, shall select some other member for the vacancy.
1.24If the legislature is not in session, vacancies in the house of representatives membership
2.1of the commission shall be filled by the last speaker of the house or, if the speaker is not
2.2available, by the last chair of the house of representatives Rules Committee, and by the last
2.3senate Committee on Committees or other appointing authority designated by the senate
2.4rules in case of a senate vacancy. The commissioner of management and budget shall be
2.5secretary of the commission and keep a permanent record and minutes of its proceedings,
2.6which are public records. The commissioner of management and budget shall transmit,
2.7under section 3.195, a report to the next legislature of all actions of the commission.
2.8Members shall receive traveling and subsistence expenses incurred attending meetings
2.9of the commission. The commission shall meet from time to time upon the call of the
2.10governor or upon the call of the secretary at the request of two or more of its members. A
2.11recommendation of the commission must be made at a meeting of the commission unless
2.12a written recommendation is signed by all the members entitled to vote on the item.
2.13EFFECTIVE DATE.This section is effective the day following final enactment.
