1.1A bill for an act
1.2relating to health; expanding application of the swimming pond exemption;
1.3amending Minnesota Statutes 2011 Supplement, section 144.1222, subdivision 5.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. Minnesota Statutes 2011 Supplement, section 144.1222, subdivision 5,
1.6is amended to read:
1.7    Subd. 5. Swimming pond exemption. (a) A public swimming pond in existence
1.8before January 1, 2008, is not a public pool for purposes of this section and section
1.9157.16 , and is exempt from the requirements for public swimming pools under Minnesota
1.10Rules, chapter 4717.
1.11    (b) Notwithstanding paragraph (a), a public swimming pond must meet the
1.12requirements for public pools described in subdivisions 1c and 1d.
1.13    (c) For purposes of this subdivision, a "public swimming pond" means an artificial
1.14body of water contained within a lined, sand-bottom basin, intended for public swimming,
1.15relaxation, or recreational use that includes a water circulation system for maintaining
1.16water quality and does not include any portion of a naturally occurring lake or stream.
1.17EFFECTIVE DATE.This section is effective the day following final enactment.
