1.2relating to transportation; requiring notice and coordination for certain
1.3transportation improvements and major projects;proposing coding for new law
1.4in Minnesota Statutes, chapter 174.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. [174.12] NOTICE AND COORDINATION; IMPROVEMENTS OR
1.7MAJOR PROJECTS.
1.8 Subdivision 1. Notice. (a) Except in an emergency, the commissioner shall notify
1.9the legislators serving the area where transportation improvements or major maintenance
1.10projects are planned or proposed of the improvement or maintenance at least 16 months
1.11prior to initiation of the project. The notice must include:
1.12(1) an explanation detailing the need for the improvement or maintenance;
1.13(2) options considered or under consideration;
1.14(3) any proposed citizen and community engagement plan;
1.15(4) an estimate of the project cost; and
1.16(5) the proposed construction schedule.
1.17(b) If a transportation improvement or major maintenance project will disrupt local
1.18traffic for more than six months, the notice provided by the commissioner under paragraph
1.19(a) must occur at least 24 months prior to initiation of the project.
1.20 Subd. 2. Coordination; planning. (a) After providing notice under subdivision 1,
1.21the commissioner shall collaborate with affected legislators and local elected officials to
1.22develop a final citizen and community engagement plan.
1.23(b) When a transportation improvement or major maintenance project will
1.24significantly disrupt area businesses and residents, the commissioner should, to the
2.1maximum extent possible, engage other state and local officials to coordinate other needed
2.2improvements to the project area.
2.3(c) When considering project implementation alternatives for projects that will
2.4negatively impact access to ten or more businesses, maximum consideration shall be
2.5given to options or alternatives that minimize the negative impact on businesses in the
2.6project area.
