1.2relating to the legislature; requiring the full house of representatives and the full
1.3senate to approve per diem and expense reimbursements for their members;
1.4amending Minnesota Statutes 2010, sections 3.099, subdivision 1; 3.101.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2010, section 3.099, subdivision 1, is amended to read:
1.7 Subdivision 1. Paydays; mileage; per diem. The compensation of each member
1.8of the legislature is due on the first day of the regular legislative session of the term and
1.9payable in equal parts on January 15, in the first month of each term and on the first
1.10day of each following month during the term for which the member was elected. The
1.11compensation of each member of the legislature elected at a special election is due on the
1.12day the member takes the oath of office and payable within ten days of taking the oath for
1.13the remaining part of the month in which the oath was taken, and then in equal parts on the
1.14first day of each following month during the term for which the member was elected.
1.15Each member shall receive mileage for necessary travel to the place of meeting and
1.16returning to the member's residence in the amount and for trips as authorized by a vote of
1.17a majority of members of the senate for senate members and by a vote of a majority of
1.18members of the house of representatives for house members.
1.19Each member shall also receive per diem living expenses during a regular or special
1.20session of the legislature in the amounts and for the purposes as determined by a vote of
1.21a majority of members of the senate for senate members and by a vote of a majority of
1.22members of the house of representatives for house members.
1.23On January 15 in the first month of each term and on the first day of each following
1.24month, the secretary of the senate and the chief clerk of the house of representatives
2.1shall certify to the commissioner of management and budget, in duplicate, the amount of
2.2compensation then payable to each member of their respective houses and its total.
2.3 Sec. 2. Minnesota Statutes 2010, section 3.101, is amended to read:
2.43.101 LIVING EXPENSES.
2.5A member of the legislature in addition to the compensation and mileage otherwise
2.6provided by law shall be reimbursed for living and other expenses incurred in the
2.7performance of duties or engaging in official business during a regular or special session
2.8and when the legislature is not in session in the manner and amount prescribed bythe
2.9senate Committee on Rules and Administration a vote of a majority of members of the
2.10senate for senators and by a vote of a majority of members of the house of representatives
2.11Committee on Rules and Legislative Administration for house of representatives members.
2.12 Sec. 3. EFFECTIVE DATE.
2.13Sections 1 and 2 are effective March 1, 2011. Payments may be made under
2.14Minnesota Statutes, section 3.099, subdivision 1, and section 3.101 on or after that date
2.15only if authorized in the manner specified in sections 1 and 2.
