1.2relating to higher education; modifying requirements for the Board of Regents
1.3and the selection of regents;amending Minnesota Statutes 2010, sections 137.02,
1.4by adding a subdivision; 137.0245, subdivision 3.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2010, section 137.02, is amended by adding a
1.7subdivision to read:
1.8 Subd. 5. Regent contracts. The Board of Regents must not enter into an
1.9employment contract or provide payment through a contract for services with an individual
1.10who is a member of the Board of Regents.
1.11EFFECTIVE DATE.This section is effective the day following final enactment
1.12for contracts entered into or renewed on or after that date.
1.13 Sec. 2. Minnesota Statutes 2010, section 137.0245, subdivision 3, is amended to read:
1.14 Subd. 3. Duties. (a) The advisory council shall:
1.15(1) develop, in consultation with current and former regents and the administration
1.16of the University of Minnesota, a statement of the selection criteria to be applied and
1.17a description of the responsibilities and duties of a regent, and shall distribute this to
1.18potential candidates; and
1.19(2) for each position on the board, identify and recruit qualified candidates for the
1.20Board of Regents, based on the background and experience of the candidates, their
1.21potential for discharging the responsibilities of a member of the Board of Regents, and the
1.22needs of the board. The selection criteria must not include a limitation on the number of
1.23terms an individual may serve on the Board of Regents.
2.1(b) The selection criteria developed under paragraph (a), clause (1), must include a
2.2criterion that regents represent diversity in geography; gender; race; occupation, including
2.3business and labor; and experience.
2.4(c) The selection criterion must include an identification of the membership needs of
2.5the board for individual skills relevant to the governance of the University of Minnesota
2.6and the needs for certain individual characteristics. Individual characteristics relate to
2.7qualities such as gender, race, and geographic location of residence.
2.8(d) The selection criteria must exclude current employees of, or persons under
2.9contract with, the Board of Regents.
2.10 Sec. 3. RESPONSIBILITIES OF INDIVIDUAL REGENTS.
2.11The Board of Regents of the University of Minnesota is requested to amend the
2.12policy on responsibilities of the board and individual regents last amended October 10,
2.132003, to include nonpartisan representation in the responsibility of individual members.
2.14The board should amend its current policy requiring individual members "to represent all
2.15the people of Minnesota and no particular interest, community, or constituency" to add
2.16"no particular political party" to that list.
2.17EFFECTIVE DATE.This section is effective the day following final enactment.
