1.1A bill for an act
1.2relating to civil actions; regulating certain human rights actions; requiring jury
1.3trials;amending Minnesota Statutes 2012, section 363A.33, subdivision 6.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. Minnesota Statutes 2012, section 363A.33, subdivision 6, is amended to read:
1.6    Subd. 6. District court jurisdiction. Any action brought pursuant to this section
1.7shall be filed in the district court of the county wherein the unlawful discriminatory
1.8practice is alleged to have been committed or where the respondent resides or has a
1.9principal place of business.
1.10Any action brought pursuant to this chapter shall be heard and determined by a
1.11judge sitting without a jury. A person bringing a civil action seeking redress for an unfair
1.12discriminatory practice is entitled to a jury trial.
1.13If the court finds that the respondent has engaged in an unfair discriminatory
1.14practice, it shall issue an order directing appropriate relief as provided by section 363A.29,
1.15subdivisions 3 to 6.
1.16When the court issues an order providing for payment to the state of a civil penalty
1.17pursuant to section 363A.29, subdivisions 3 to 6, it shall serve a copy of that order upon
1.18the attorney general at the same time as it makes service upon the parties.
