1.1A bill for an act
1.2relating to education; providing for a charter school; authorizing annual portfolio
1.3report;amending Minnesota Statutes 2012, section 124D.10, subdivision 14.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. Minnesota Statutes 2012, section 124D.10, subdivision 14, is amended to
1.6read:
1.7    Subd. 14. Annual public reports. (a) A charter school must publish an annual report
1.8approved by the board of directors. The annual report must at least include information
1.9on school enrollment, student attrition, governance and management, staffing, finances,
1.10academic performance, operational performance, innovative practices and implementation,
1.11and future plans. A charter school must distribute the annual report by publication, mail,
1.12or electronic means to the commissioner, authorizer, school employees, and parents and
1.13legal guardians of students enrolled in the charter school and must also post the report on
1.14the charter school's official Web site. The reports are public data under chapter 13.
1.15(b) An authorizer must annually aggregate the reports of all schools that it charters
1.16and are published in accordance with paragraph (a) and submit a portfolio report to the
1.17commissioner and the public. An authorizer's annual portfolio report must include:
1.18(1) the academic and financial performance of all operating charter schools overseen
1.19by the authorizer;
1.20(2) the status of the authorizer's charter school portfolio, identifying all charter
1.21schools in each of the following categories: approved, but not open; open and operating;
1.22and closed, including the year closed and reason for closure;
2.1(3) the authorizing function provided by the authorizer to the charter schools within
2.2its portfolio, including the authorizer's operating costs and expenses detailed in annual
2.3audited financial statements that conform to generally accepted accounting principles; and
2.4(4) an authorizer with a charter school performing in the bottom 25 percent of both
2.5the state's multiple measures rating and focus rating under the waiver from the federal
2.6Elementary and Secondary Education Act, with the exception of charter schools that fall
2.7under the provisions outlined in paragraph (d), shall also include a strategic plan to elevate
2.8applicable charter schools from the bottom 25 percent.
2.9(c) An authorizer shall publish on its Web site the performance of all charter schools
2.10within its portfolio.
2.11(d) The reporting requirement outlined in paragraph (b), clause (4), does not apply
2.12to a charter school:
2.13(1) that has limited admission to students eligible to participate in the graduation
2.14incentives program under section 124D.68;
2.15(2) where 70 percent or more of enrolled students are eligible to participate in the
2.16graduation incentives program under section 124D.68; or
2.17(3) where 50 percent or more of enrolled students are eligible students with
2.18disabilities.
