1.1A bill for an act
1.2relating to public safety; proposing new penalties for repeat violators of certain
1.3motor vehicle property crimes; amending Minnesota Statutes 2010, section
1.4609.546.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Minnesota Statutes 2010, section 609.546, is amended to read:
1.7609.546 MOTOR VEHICLE TAMPERING.
1.8    Subdivision 1. Misdemeanor. A person is guilty of a misdemeanor who
1.9intentionally:
1.10(1) rides in or on a motor vehicle knowing that the vehicle was taken and is being
1.11driven by another without the owner's permission; or
1.12(2) tampers with or enters into or on a motor vehicle without the owner's permission.
1.13    Subd. 2. Gross misdemeanor. A person is guilty of a gross misdemeanor who
1.14violates subdivision 1 after having been previously convicted or adjudicated delinquent
1.15two or more times for violating subdivision 1; section 609.52, subdivision 2, clause (17);
1.16609.53; 609.59; or 609.595.
1.17EFFECTIVE DATE.This section is effective August 1, 2012, and applies to crimes
1.18committed on or after that date.
