1.1A bill for an act
1.2relating to natural resources; providing for surcharge to develop and maintain
1.3records management system; appropriating money;amending Minnesota
1.4Statutes 2012, sections 84.788, subdivision 6; 84.798, subdivision 6; 84.82,
1.5subdivision 3; 84.922, subdivision 5; 86B.415, subdivision 9; 97A.065, by
1.6adding a subdivision; 97A.475, by adding a subdivision.
1.7BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.8    Section 1. Minnesota Statutes 2012, section 84.788, subdivision 6, is amended to read:
1.9    Subd. 6. Registration fees. (a) The fee for registration of an off-highway
1.10motorcycle under this section, other than those registered by a dealer or manufacturer
1.11under paragraph (b) or (c), is $30 for three years and $4 for a duplicate or transfer.
1.12(b) The total registration fee for off-highway motorcycles owned by a dealer and
1.13operated for demonstration or testing purposes is $50 per year. Dealer registrations are
1.14not transferable.
1.15(c) The total registration fee for off-highway motorcycles owned by a manufacturer
1.16and operated for research, testing, experimentation, or demonstration purposes is $150
1.17per year. Manufacturer registrations are not transferable.
1.18(d) Except as provided under paragraph (e), the fees collected under this subdivision
1.19must be deposited in the state treasury and credited to the off-highway motorcycle account.
1.20(e) Fees for a registration issued under this subdivision must be increased by a
1.21surcharge of 25 cents for development and maintenance of a records management system.
1.22The surcharge must be deposited according to section 97A.065, subdivision 7. An
1.23additional commission may not be assessed on the surcharge.
1.24EFFECTIVE DATE.This section is effective January 1, 2014.

2.1    Sec. 2. Minnesota Statutes 2012, section 84.798, subdivision 6, is amended to read:
2.2    Subd. 6. Registration fees. (a) The fee for registration of an off-road vehicle under
2.3this section, other than those registered by a dealer or manufacturer under paragraph (b) or
2.4(c), is $30 for three years and $4 for a duplicate or transfer.
2.5(b) The total registration fee for off-road vehicles owned by a dealer and operated
2.6off-road for demonstration or testing purposes is $50 per year. Dealer registrations are
2.7not transferable.
2.8(c) The total registration fee for off-road vehicles owned by a manufacturer and
2.9operated off-road for research, testing, experimentation, or demonstration purposes is
2.10$150 per year. Manufacturer registrations are not transferable.
2.11(d) Except as provided under paragraph (e), the fees collected under this subdivision
2.12must be credited to the off-road vehicle account in the natural resources fund.
2.13(e) Fees for a registration issued under this subdivision must be increased by a
2.14surcharge of 25 cents for development and maintenance of a records management system.
2.15The surcharge must be deposited according to section 97A.065, subdivision 7. An
2.16additional commission may not be assessed on the surcharge.
2.17EFFECTIVE DATE.This section is effective January 1, 2014.

2.18    Sec. 3. Minnesota Statutes 2012, section 84.82, subdivision 3, is amended to read:
2.19    Subd. 3. Fees for registration. (a) The fee for registration of each snowmobile,
2.20other than those used for an agricultural purpose, as defined in section 84.92, subdivision
2.211c, or those registered by a dealer or manufacturer pursuant to paragraph (b) or (c) shall be
2.22as follows: $75 for three years and $10 for a duplicate or transfer.
2.23(b) The total registration fee for all snowmobiles owned by a dealer and operated for
2.24demonstration or testing purposes shall be $50 per year.
2.25(c) The total registration fee for all snowmobiles owned by a manufacturer and
2.26operated for research, testing, experimentation, or demonstration purposes shall be $150
2.27per year. Dealer and manufacturer registrations are not transferable.
2.28(d) The onetime fee for registration of an exempt snowmobile under subdivision
2.296a is $6.
2.30(e) Fees for a registration issued under this subdivision must be increased by a
2.31surcharge of 25 cents for development and maintenance of a records management system.
2.32Notwithstanding section 84.83, subdivision 2, the surcharge must be deposited according
2.33to section 97A.065, subdivision 7. An additional commission may not be assessed on
2.34the surcharge.
3.1EFFECTIVE DATE.This section is effective July 1, 2013.

3.2    Sec. 4. Minnesota Statutes 2012, section 84.922, subdivision 5, is amended to read:
3.3    Subd. 5. Fees for registration. (a) The fee for a three-year registration of
3.4an all-terrain vehicle under this section, other than those registered by a dealer or
3.5manufacturer under paragraph (b) or (c), is:
3.6    (1) for public use, $45;
3.7    (2) for private use, $6; and
3.8    (3) for a duplicate or transfer, $4.
3.9    (b) The total registration fee for all-terrain vehicles owned by a dealer and operated for
3.10demonstration or testing purposes is $50 per year. Dealer registrations are not transferable.
3.11    (c) The total registration fee for all-terrain vehicles owned by a manufacturer and
3.12operated for research, testing, experimentation, or demonstration purposes is $150 per
3.13year. Manufacturer registrations are not transferable.
3.14    (d) The onetime fee for registration of an all-terrain vehicle under subdivision 2b is $6.
3.15(e) Except as provided under paragraph (f), the fees collected under this subdivision
3.16must be credited to the all-terrain vehicle account.
3.17(f) Fees for a registration issued under this subdivision must be increased by a
3.18surcharge of 25 cents for development and maintenance of a records management system.
3.19The surcharge must be deposited according to section 97A.065, subdivision 7. An
3.20additional commission may not be assessed on the surcharge.
3.21EFFECTIVE DATE.This section is effective January 1, 2014.

3.22    Sec. 5. Minnesota Statutes 2012, section 86B.415, subdivision 9, is amended to read:
3.23    Subd. 9. Disposition of receipts. (a) Except as provided under paragraph (b),
3.24money received for watercraft licenses shall be deposited in the state treasury and credited
3.25to the water recreation account.
3.26(b) Fees for a license issued under this section must be increased by a surcharge
3.27of 25 cents for development and maintenance of a records management system. The
3.28surcharge must be deposited according to section 97A.065, subdivision 7. An additional
3.29commission may not be assessed on the surcharge.
3.30EFFECTIVE DATE.This section is effective January 1, 2014.

3.31    Sec. 6. Minnesota Statutes 2012, section 97A.065, is amended by adding a subdivision
3.32to read:
4.1    Subd. 7. Enforcement records management surcharge. The records management
4.2surcharge collected under sections 84.788, subdivision 6; 84.798, subdivision 6; 84.82,
4.3subdivision 3; 84.922, subdivision 5; 86B.415, subdivision 9; and 97A.475, subdivision
4.446, shall be deposited in an account in the special revenue fund and is appropriated
4.5annually to the commissioner for development and maintenance of a records management
4.6system in the Division of Enforcement.
4.7EFFECTIVE DATE.This section is effective July 1, 2013.

4.8    Sec. 7. Minnesota Statutes 2012, section 97A.475, is amended by adding a subdivision
4.9to read:
4.10    Subd. 46. Enforcement records management surcharge. (a) Except as provided
4.11in paragraph (b), fees for a license issued under this section must be increased by a
4.12surcharge of 25 cents for development and maintenance of a records management system.
4.13(b) Licenses issued to residents and nonresidents under age 18, stamps and stamp
4.14validations, duplicate licenses, and replacement licenses issued under this section are
4.15exempt from the surcharge under paragraph (a).
4.16(c) An additional commission may not be assessed on the surcharge.
4.17EFFECTIVE DATE.This section is effective March 1, 2014.
