1.2relating to waters; exempting minor ditch repairs from certain environmental
1.3civil actions;amending Minnesota Statutes 2012, section 103E.701, by adding a
1.4subdivision.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2012, section 103E.701, is amended by adding a
1.7subdivision to read:
1.8 Subd. 8. Minor ditch repair. Minor repairs to ditches undertaken by a drainage
1.9authority are not subject to civil actions under section 116B.03. For purposes of this
1.10subdivision, "minor repair" includes routine maintenance, resloping a ditch, removing
1.11obstructions, and other routine repairs that are not subject to bidding requirements under
1.12section 103E.705, subdivision 5.
