SENATE JOINT RESOLUTION G

 

 

March 8, 2017, Introduced by Senators HILDENBRAND, PAVLOV, PROOS, NOFS, SHIRKEY, CASPERSON, GREEN, HORN, COLBECK, JONES, HANSEN, CONYERS, MACGREGOR, MARLEAU, ZORN, ROBERTSON, SCHUITMAKER, STAMAS, KOWALL, SCHMIDT, EMMONS, HUNE and MEEKHOF and referred to the Committee on Outdoor Recreation and Tourism.

 

 

     A joint resolution proposing an amendment to the state

 

constitution of 1963, by adding section 28 to article I, to

 

recognize a right to hunt, fish, and harvest wildlife.

 

     Resolved by the Senate and House of Representatives of the

 

state of Michigan, That the following amendment to the state

 

constitution of 1963, to recognize a right to hunt, fish, and

 

harvest wildlife, is proposed, agreed to, and submitted to the

 

people of the state:

 

ARTICLE I

 

     Sec. 28. The right to hunt, fish, and harvest wildlife is a

 

valued part of Michigan's heritage and shall be forever preserved

 

for the public good. The people have a right, which includes the

 

right to use traditional methods, to hunt, fish, and harvest


wildlife, subject only to the laws prescribed by the legislature

 

and rules prescribed by virtue of the authority of the legislature

 

to promote wildlife conservation and management and preserve the

 

future of hunting and fishing. Hunting and fishing is a preferred

 

means of managing and controlling wildlife. This section shall not

 

be construed to limit the application of any provision of law

 

relating to trespass or property rights.

 

     Resolved further, That the foregoing amendment shall be

 

submitted to the people of the state at the next general election

 

in the manner provided by law.
