SENATE BILL NO. 974
A bill to amend 1939 PA 280, entitled
"The social welfare act,"
(MCL 400.1 to 400.119b) by adding section 109q.
the people of the state of michigan enact:
Sec. 109q. Beginning January 1, 2026, the department shall provide coverage, under the medical assistance program, for over-the-counter contraception and emergency contraception without a prescription. As used in this section:
(a) "Contraception" means a drug, device, or other product covered by the medical assistance program that is approved by the United States Food and Drug Administration to prevent pregnancy. Contraception includes, but is not limited to, a hormonal drug, whether administered orally, transdermally, or intravaginally.
(b) "Emergency contraception" means a drug approved by the United States Food and Drug Administration to prevent pregnancy following unprotected sexual intercourse or a known or suspected contraceptive failure.
