SENATE BILL NO. 902

April 30, 2020, Introduced by Senator MOSS and referred to the Committee on Government Operations.

A bill to amend 1949 PA 300, entitled

"Michigan vehicle code,"

(MCL 257.1 to 257.923) by adding section 307c.

the people of the state of michigan enact:

Sec. 307c. (1) The secretary of state may extend the deadline for the renewal of an individual's operator's license or chauffeur's license and may waive the penalty for the late renewal of an individual's operator's license or chauffeur's license if both of the following apply:

(a) The governor issued an executive order declaring a state of disaster or a state of emergency under the emergency management act, 1976 PA 390, MCL 30.401 to 30.421.

(b) The individual's operator's license or chauffeur's license expired during the period of the state of disaster or the state of emergency.

(2) If the secretary of state extends the deadline for the renewal of an individual's operator's or chauffeur's license under subsection (1), it may provide that the operator's or chauffeur's license is valid for 60 days after the termination of the state of disaster or the state of emergency.

(3) The secretary of state may waive the penalty for the late renewal of the operator's or chauffeur's license if both of the following apply:

(a) An individual's operator's or chauffeur's license expired 1 week before the governor declared a state of disaster or a state of emergency under the emergency management act, 1976 PA 390, MCL 30.401 to 30.421.

(b) The secretary of state closed its branches before the governor declared the state of disaster or state of emergency under the emergency management act, 1976 PA 390, MCL 30.401 to 30.421.

(4) This section does not apply if an individual's operator's or chauffeur's license was suspended or restricted before the state of disaster or the state of emergency.

(5) As used in this section:

(a) "State of disaster" means that term as defined in section 2 of the emergency management act, 1976 PA 390, MCL 30.402.

(b) "State of emergency" means that term as defined in section 2 of the emergency management act, 1976 PA 390, MCL 30.402.

Enacting section 1. This amendatory act does not take effect unless all of the following bills of the 100th Legislature are enacted into law:

(a) Senate Bill No. 903.

 

(b) Senate Bill No. 904.
