SENATE BILL NO. 776

A bill to require that owners, operators, and employees of hotels in this state are trained to identify potential victims of human trafficking and to recognize the activities commonly associated with human trafficking; to require that the owner or operator of a hotel maintain a record of guest transactions and receipts for a certain period of time; and to provide for the powers and duties of certain governmental officers and entities.

the people of the state of michigan enact:

Sec. 1. This act shall be known and may be cited as the "hospitality education against trafficking act".

Sec. 2. As used in this act:

(a) "Hotel" means a building or group of buildings located on the same or adjoining pieces of real property that is used in the business of providing lodging to travelers and temporary residents. Hotel includes a motel, inn, or other similar lodging.    

(b) "Human trafficking" means a violation of chapter LXVIIA of the Michigan penal code, 1931 PA 328, MCL 750.462a to 750.462h.

(c) "Human trafficking commission" or "commission" means the human trafficking commission established in section 3 of the human trafficking commission act, 2014 PA 325, MCL 752.973.

Sec. 3. An owner or operator of a hotel located in this state shall do all of the following:

(a) Ensure that each employee of the hotel, including management personnel, not more than 14 days after the date of hire and every 2 years after that date, receives training to recognize the following:

(i) Commonly accepted indicators for identifying an individual present in the hotel as a potential victim of human trafficking.

(ii) Activities commonly associated with human trafficking.

(b) On or before December l, 2020, and annually after that date, certify in the personnel file of each employee of the hotel, including management personnel, that the employee has received the training described in subdivision (a).

(c) Maintain an ongoing employee awareness campaign on recognizing the indicators and activities described in subdivision (a).

(d) Create and maintain a system for reporting the indicators and activities described in subdivision (a) to the owner, operator, or management personnel of the hotel.

(e) Ensure that the owner or operator, and any associated individual involved in the direct management or control of the hotel, has received the training described in subdivision (a) not more than 6 months after the effective date of this act. If a person has newly acquired an ownership interest in a hotel, or is a newly appointed operator, the person must ensure that the owner or operator, and any associated individual involved in the direct management or control of the hotel, receives the training described in subdivision (a) not more than 6 months after taking ownership or operator status. The owner or operator must keep a verifiable record of the training described in this subdivision in the business records of the hotel.

(f) Create and maintain a record-keeping system for all hotel guest transactions and receipts. The owner or operator must retain the records maintained under this subdivision for not less than 6 months after the date the record is created.

Sec. 5. The human trafficking commission shall develop standards and recommend an educational training program, including subsequent refresher programs, on the accurate and prompt identification and reporting of suspected human trafficking that may be occurring on the premises of a hotel. The training program shall include a video presentation, developed or approved by the commission, that provides guidance to owners, operators, and employees of a hotel on recognizing the indicators and activities described in section 3(a).

Enacting section 1. This act takes effect 90 days after the date it is enacted into law.
