SENATE BILL No. 673

 

 

June 25, 2009, Introduced by Senators KUIPERS, BIRKHOLZ and PAPPAGEORGE and referred to the Committee on Judiciary.

 

 

 

     A bill to amend 1978 PA 397, entitled

 

"Bullard-Plawecki employee right to know act,"

 

(MCL 423.501 to 423.512) by amending the title and by adding

 

section 6a.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

TITLE

 

     An act to permit employees to review personnel records; to

 

provide criteria for the review; to prescribe the information which

 

that may be contained in personnel records; to protect employee

 

privacy rights in certain information in employment records; and to

 

provide penalties.

 

     Sec. 6a. (1) An employer or former employer shall not divulge

 

an employee's home or cellular telephone number, home address,


 

personal electronic mail address, or age to a third party who is

 

not a part of the employer's organization unless the employee has

 

given written consent to the disclosure.

 

     (2) Subsection (1) does not apply to the following:

 

     (a) A disclosure ordered in a legal action or arbitration.

 

     (b) Information supplied to a government officer, employee, or

 

agency in furtherance of a governmental function.
