SENATE BILL NO. 531

June 10, 2021, Introduced by Senators MCBROOM, BUMSTEAD and HORN and referred to the Committee on Economic and Small Business Development.

A bill to amend 1936 (Ex Sess) PA 1, entitled

"Michigan employment security act,"

(MCL 421.1 to 421.75) by adding section 69.

the people of the state of michigan enact:

Sec. 69. (1) Notwithstanding any other provision of this act, the unemployment agency shall not enter into an agreement with a third party to perform a duty of the unemployment agency prescribed to it by law unless both of the following conditions are met:

(a) The third party does both of the following:

(i) Obtains a criminal history background check conducted by a law enforcement agency of each of the third party's employees or independent contractors who will be involved in performing the duty of the unemployment agency.

(ii) Provides to the unemployment agency the results of all of the criminal history background checks described in subparagraph (i).

(b) The agreement requires the third party to do both of the following:

(i) Obtain a criminal history background check conducted by a law enforcement agency of each of the third party's employees or independent contractors who are hired or engaged during the term of the contract and who will be involved in performing the duty of the unemployment agency.

(ii) Provide to the unemployment agency the results of all of the criminal history background checks described in subparagraph (i).

(2) The unemployment agency shall do both of the following with respect to third parties that have provided criminal history background checks to the unemployment agency under subsection (1):

(a) Maintain a list of the third parties.

(b) Designate 1 or more employees whose duty it is to ensure that the third parties comply with this section and the terms of an agreement described in subsection (1).
