May 1, 2013, Introduced by Senators MOOLENAAR, MARLEAU, EMMONS, BOOHER, JONES, COLBECK, GREEN, BRANDENBURG, MEEKHOF, HUNE, ROBERTSON, KOWALL and ROCCA and referred to the Committee on Families, Seniors and Human Services.
A bill to amend 1939 PA 280, entitled
"The social welfare act,"
(MCL 400.1 to 400.119b) by adding section 10h.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 10h. (1) Except as otherwise provided in this section,
any person who is receiving or has, in the previous 10 years,
received assistance under this act and who wins a lottery prize of
$600.00 or more shall reimburse the department from the lottery
winnings for all the assistance benefits paid to that person or his
or her family group during the previous 10 years.
(2) The amount paid to the department shall not be more than
50% of the amount of the lottery prize. The department director
shall enter into an agreement with the lottery commissioner for
crediting the lottery prizes against assistance received under this
act.
(3) The department shall not recover payments made to an
assistance recipient for assistance that was reimbursed by child
support collections.
(4) This section does not prohibit recovery under any other
provision of this act.
