SENATE BILL NO. 249

March 17, 2021, Introduced by Senator LASATA and referred to the Committee on Education and Career Readiness.

A bill to amend 1976 PA 451, entitled

"The revised school code,"

(MCL 380.1 to 380.1852) by adding section 1233d.

the people of the state of michigan enact:

Sec. 1233d. (1) Beginning on the effective date of the amendatory act that added this section through June 30, 2026, if the department issues a daily substitute permit to an individual during a period when an unusual and extenuating circumstance resulting from conditions not within the control of school authorities of the school in which the individual is assigned to substitute teach, including, but not limited to, a natural disaster, an emergency school closure, or an emergency health condition as defined by city, county, or state health authorities that impacts the school in which the individual is assigned to substitute teach is occurring, and, during the period described in this subsection, the school district, intermediate school district, or public school academy in which the individual is substitute teaching under the permit determines that the individual's substitute-teaching services, as authorized under the permit, will be needed past the expiration date of the permit, the permit is automatically extended and valid for an additional 90 calendar days beyond the initial expiration date of the permit and the individual may continue to substitute teach under the permit for the 90 calendar days beyond the initial expiration date of the permit.

(2) A school district, intermediate school district, or public school academy shall notify the department of a determination under subsection (1) before the initial expiration date of the permit as described in subsection (1).

(3) As used in this section, "daily substitute permit" means a permit issued by the department to which both of the following apply:

(a) The permit is issued to an individual who has completed at least 60 semester hours of satisfactory credit combined from 1 or more regionally accredited 2- or 4-year colleges or universities. As used in this subdivision, "satisfactory credit" means obtaining a grade of C or better for the credit.

(b) The permit, as initially issued, before the application of an automatic extension under subsection (1), permits an individual described in subdivision (a) to substitute teach in the public schools of this state in 1 teaching assignment for not more than 90 calendar days when a teacher is temporarily unavailable.
