A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
(MCL 324.101 to 324.90106) by adding section 8316c.
the people of the state of michigan enact:
Sec. 8316c. (1) The department shall
maintain a voluntary registry of individuals who are required to be notified
before the application of a lawn or ornamental pesticide, other than a
general-use ready-to-use pesticide, but only if both of the following
conditions apply:
(a)
The pesticide application is on or adjacent to the individual's property.
(b)
There is a declared public health emergency that requires the pesticide
application.
(2)
The registry created under subsection (1) must contain a list of those
properties adjacent to the individual's primary residence. The notification to
an individual listed in the registry must meet both of the following
requirements:
(a)
Be provided by the means of contact specified in the registry not less than 48
hours before the pesticide application.
(b)
State that the pesticide is scheduled to be applied on or adjacent to 1 or more
properties listed in the registry.
(3) An individual who wishes to be notified before a pesticide application shall annually apply on a form and in a manner prescribed by the department. The individual must include on the form detailed and accurate information on the individual's property and a preferred means of contact for the notification.
