A bill to prohibit certain employers from employing certain
individuals as adult performers; and to provide certain remedies
and penalties.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 1. This act shall be known and may be cited as the "adult
performer minimum age act".
Sec. 3. As used in this act:
(a) "Adult performer" means an individual who disrobes or
performs in an unclothed state for entertainment at an
establishment that holds a topless activity permit under section
916(3) of the Michigan liquor control code of 1998, 1998 PA 58, MCL
436.1916, or any other establishment that provides adult-oriented
entertainment.
(b) "Employ" means to engage or permit to work.
(c) "Employer" means a person that employs 1 or more
individuals.
Sec. 5. (1) Except as provided in subsection (2), an employer
shall not employ an individual who is less than 21 years of age as
an adult performer.
(2) This act does not apply to employment described in
subsection (1) if the individual who is less than 21 years of age
was employed as an adult performer before the effective date of
this act.
Sec. 7. An employer that violates this act is guilty of a
misdemeanor punishable by imprisonment for not more than 90 days or
a fine of not more than $5,000.00, or both. An employer that
violates this act for a second or subsequent time is guilty of a
misdemeanor punishable by imprisonment for not more than 90 days
and a fine of not more than $10,000.00. Each violation is a
separate offense.
Enacting section 1. This act takes effect 90 days after the
date it is enacted into law.
