HOUSE BILL No. 5859

 

September 11, 2012, Introduced by Rep. Irwin and referred to the Committee on Agriculture.

 

     A bill to amend 2006 PA 110, entitled

 

"Michigan zoning enabling act,"

 

(MCL 125.3101 to 125.3702) by adding section 205b.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 205b. (1) A structure and associated equipment for

 

measuring wind speed is an authorized use in all agricultural

 

zones, subject to subsections (2) and (3).

 

     (2) A tower authorized under subsection (1) shall not be

 

located within a distance of 1.1 times the height of the tower from

 

any of the following:

 

     (a) A road, street, or highway.

 

     (b) A railroad.

 

     (c) A property line of a parcel that is not owned or leased by

 

the owner of the tower.

 

     (d) A building, other than a utility building associated with

 

another structure for measuring wind speed.

 

     (3) A zoning ordinance may require a structure and associated

 

equipment for measuring wind speed to be removed within 5 years

 

after it is constructed or installed.
