HOUSE BILL No. 5632

 

 

February 22, 2018, Introduced by Reps. Dianda, Chirkun, Marino, Green, Farrington, LaFave and Lucido and referred to the Committee on Insurance.

 

     A bill to amend 1857 PA 72, entitled

 

"An act amendatory to the several acts in relation to the Wesleyan

Seminary at Albion, and the Albion Female Collegiate Institute,"

 

by amending section 7b (MCL 390.707b), as added by 2011 PA 220.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 7b. The college assumes the liability for all acts or

 

omissions of a person who is a volunteer trustee or nontrustee

 

volunteer occurring on or that occur after the effective date of

 

the amendatory act that added this section November 14, 2011, if

 

all of the following are met:apply:

 

     (a) The person was acting or reasonably believed he or she was

 

acting within the scope of his or her authority.

 

     (b) The volunteer was acting in good faith.

 

     (c) The volunteer's conduct did not amount to gross negligence

 

or willful and wanton misconduct.


     (d) The volunteer's conduct was not an intentional tort.

 

     (e) The volunteer's conduct was not a tort arising out of the

 

ownership, maintenance, or use of a motor vehicle. for which tort

 

liability may be imposed under section 3135 of the insurance code

 

of 1956, 1956 PA 218, MCL 500.3135.

 

     Enacting section 1. This amendatory act takes effect January

 

1, 2019.

 

     Enacting section 2. This amendatory act does not take effect

 

unless Senate Bill No. ____ or House Bill No. 5627 (request no.

 

05366'18) of the 99th Legislature is enacted into law.
