A bill to amend 1976 PA 453, entitled

"Elliott-Larsen civil rights act,"

by amending section 801 (MCL 37.2801).

the people of the state of michigan enact:

Sec. 801. (1) A person alleging a violation of this act may bring a civil action for appropriate injunctive relief or damages, or both. If a court determines that an employer violated section 202, the court shall award treble damages.

(2) An action commenced pursuant to under subsection (1) may be brought in the circuit court for the county where the alleged violation occurred, or for the county where the person against whom the civil complaint is filed resides or has his where the person's principal place of business is located.

(3) A claim for an action brought under subsection (1) accrues on the date the person alleging the violation acquires actual knowledge of the violation.

(4) (3) As used in subsection (1), "damages" means damages for injury or loss caused by each violation of this act, including reasonable attorney's attorney fees.

Enacting section 1. This amendatory act takes effect 90 days after the date it is enacted into law.
