HOUSE BILL NO. 5498

A bill to amend 2011 PA 258, entitled

"Municipal partnership act,"

(MCL 124.111 to 124.123) by adding section 3a.

the people of the state of michigan enact:

Sec. 3a. If a party to a contract providing for a joint endeavor includes a county with a population of more than 1,000,000 and less than 1,500,000, and that joint endeavor proposes a tax as authorized under section 7, the county must provide notice regarding the proposed tax not less than 90 days before a vote on the proposed tax to each city, village, and township located in that county. Upon receipt of a notice from the county under this section, any city, village, or township located in that county may, by resolution adopted by the governing body of that city, village, or township not less than 60 days before a vote on the proposed tax by the joint endeavor, vote to opt out of the joint endeavor. If a city, village, or township opts out of the joint endeavor, both of the following apply:

(a) The joint endeavor shall not levy any mills against any taxable property located in that city, village, or township.

(b) The electors of that city, village, or township are not eligible to vote on any proposal for a tax under section 7.
