SUBSTITUTE FOR
HOUSE BILL NO. 5419
A bill to amend 1978 PA 368, entitled
"Public health code,"
by amending sections 16336, 17901, 17905, and 17906 (MCL
333.16336, 333.17901, 333.17905, and 333.17906), as added by 2006
PA 54.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 16336. Fees for a person licensed or seeking licensure
2 as an athletic trainer under part 179 are as follows:
3 (a) Application processing fee................ $ 75.00.

(b) License fee, per year..................... $ 200.00.
5 $ 100.00.
6 Sec. 17901. (1) As used in this part:
1 (a) "Athletic trainer" means an individual engaged in the
2 practice of athletic training.
3 (b) "Practice of athletic training" means the treatment of
4 an individual for risk management and injury prevention, the
5 clinical evaluation and assessment of an individual for an injury
6 or illness, or both, the immediate care and treatment of an
7 individual for an injury or illness, or both, and the
8 rehabilitation and reconditioning of an individual's injury or
9 illness, or both, as long as if those activities are
within the
10 rules promulgated under section 17904 and performed under the
11 direction and supervision of, on the prescription of, or in
12
collaboration with an individual
licensed under part 166, 170, or
13 175, or 180. The practice of athletic training does not include
14 the practice of physical therapy, the practice of medicine, the
15 practice of osteopathic medicine and surgery, the practice of
16 chiropractic, the practice of dentistry, the practice of
17 podiatric medicine and surgery, or medical diagnosis or
18 treatment.
19 (2) In addition to the definitions in this part, article 1
20 contains general definitions and principles of construction
21 applicable to all articles in this code and part 161 contains
22 definitions applicable to this part.
23 Sec. 17905. (1) The department shall issue a license under
24 this article as an athletic trainer to an individual who meets
25 all of the following requirements:
26 (a) Applies to the department on a form provided by the
27 department.
1 (b) Meets the requirements for licensure promulgated in
2 rules pursuant to section 17904.
3 (c) Pays the fees prescribed in section 16336.
4 (2) The department shall promulgate rules to provide for
5
require at least 80 75 clock
hours of continuing education within
6 each 3-year license cycle in subjects related to athletic
7 training and approved by the department.
8 Sec. 17906. (1) A The
department shall issue a license
9 issued by the department under
section 17905 shall be for a 3-
10 year license cycle. The license is renewable upon payment of the
11 prescribed license renewal fee and , beginning with the
third
12 year after the effective date of the rules promulgated under
13 section 17905(2), submission
to the department of proof of
14 satisfactory completion of at least 80 75 clock
hours of
15 continuing education within the 3-year license cycle in subjects
16 related to athletic training and approved by the department.
17 (2) In addition to the continuing education requirements of
18 subsection (1), an athletic trainer shall submit along with his
19 or her application for license renewal proof satisfactory to the
20 department of both of the following:
21 (a) That he or she has successfully completed a course of
22 training in first aid, cardiopulmonary resuscitation, and foreign
23 body obstruction of the airway automated external defibrillator
24 use for health care professionals or emergency services personnel
25 approved by the department and offered or approved by the
26 American Red Cross, the American heart association, or a
27 comparable organization, as determined by the department.
1 (b) That he or she holds, at the time of application for
2 renewal and at all times during the previous license period, a
3 valid certification in first aid and cardiopulmonary
4 resuscitation issued by the organization offering the training.
