HOUSE BILL NO. 5417
A bill to amend 1978 PA 368, entitled
"Public health code,"
(MCL 333.1101 to 333.25211) by adding section 16328a and by adding sections 17353, 17355, 17357, 17358, 17359, and 17361 to part 173A.

Sec. 16328a. Fees for an individual licensed or seeking licensure as a state licensed medical assistant under part 173A are as follows:

Sec. 17353. (1) Beginning on January 1, 2025, an individual shall not engage in the practice of medical assisting unless licensed or otherwise authorized by this article.
(2) Beginning on January 1, 2025, the following words, titles, or letters or a combination thereof, with or without qualifying words or phrases, are restricted in use only to those individuals authorized under this part to use the following terms and in a way prescribed in this part: "medical assistant", "clinical assistant", "state licensed medical assistant", "l.m.a.", or "m.a.".
Sec. 17355. (1) The Michigan board of medical assistants is created within the department. The board consists of the following 15 members, each of whom must meet the requirements of part 161:
(a) Eight state licensed medical assistants.
(b) Two of any of the following:
(i) A physician.
(ii) A chiropractor.
(iii) A podiatric physician.
(c) Two nurse practitioners.
(d) Two physician's assistants.
(e) One public member.
(2) Except as otherwise provided in this subsection, the terms of office of individual members of the board created under subsection (1), except those appointed to fill vacancies, expire 4 years after appointment on December 31 of the year in which the term will expire. For members first appointed under this section, 5 members shall serve for 2 years, 5 members shall serve for 3 years, and 5 members shall serve for 4 years.
Sec. 17357. (1) Except as otherwise provided in subsection

(3), the board shall grant a license under this part to an individual who, in addition to meeting the requirements of section 16174, meets all of the following requirements:
(a) Subject to subsection (2), the individual has successfully completed 1 of the following:
(i) Postsecondary training in medical assisting from an educational program that is accredited by the Accrediting Bureau of Health Education Schools, the Commission for Accreditation of Allied Health Education Programs, or another accrediting organization approved by the board.
(ii) An educational program in medical assisting from a school that is institutionally accredited by an accrediting agency that is recognized by the United States Department of Education or by another accrediting organization approved by the board.
(b) The individual holds a certification from the American Association of Medical Assistants, the American Medical Technologists, the National Certification Medical Association, or an equivalent certification, as determined by the board.
(c) Any other requirements for licensure established by the board.
(2) The postsecondary training and education program required under subsection (1)(a) must include courses in anatomy and physiology, medical terminology, pharmacology, medical laboratory techniques, and clinical experience.
(3) The board shall grant a license to an individual who meets the requirements of section 16174 and who demonstrates to the satisfaction of the board that the individual has been engaging in the practice of medical assisting for any amount of time during the 2-year period immediately preceding January 1, 2025.

Sec. 17358. (1) Notwithstanding the requirements of part 161, the board may require a licensee seeking renewal of a license to furnish the board with satisfactory evidence that during the 3 years immediately preceding application for renewal the licensee has attended an appropriate number of hours or continuing education courses or programs approved by the board in subjects designed to further educate licensees.
(2) An individual is considered to have completed the continuing education requirements described in subsection (1) if the board determines that the individual has met the continuing education standards of the American Association of Medical Assistants or equivalent standards as determined by the board. If, after the effective date of the amendatory act that added this section, the American Association of Medical Assistants revises its continuing education standards, the board may promulgate rules to incorporate the revision by reference.
(3) In addition to the continuing education required under subsection (1), the board shall promulgate rules requiring each applicant for license renewal to complete an appropriate number of hours or courses in pain and symptom management as a condition for license renewal as required under section 16204.
Sec. 17359. The board shall promulgate rules to implement this part.
Sec. 17361. This part does not require new or additional third-party reimbursement or mandated worker's compensation benefits for services rendered by a state licensed medical assistant.
Enacting section 1. This amendatory act does not take effect unless Senate Bill No.____ or House Bill No. 5416 (request no.

04122'23) of the 102nd Legislature is enacted into law.
